Louisiana fans of comedian Tracy Morgan may be interested in the news that the truck driver involved in the accident that seriously injured Morgan will go to court in April. Another comedian was killed in the accident in June 2014.The man was a driver for Wal-Mart at the time of the accident, and the company has paid an undisclosed settlement to Morgan. According to reports, the driver had been awake for more than 24 hours when the accident occurred.
The National Transportation Safety Board found that the driver had been awake for more than 24 hours at the time of the accident and that the sleep deprivation was a factor in his failure to heed traffic signs and to slow down right before the crash. The fact that Morgan and the other passengers in the limo-bus that was hit by the truck were not wearing seat belts contributed to their injuries.
The driver has pleaded not guilty to vehicular homicide, aggravated manslaughter and aggravated assault. If convicted, the possible penalties he faces include lengthy incarceration. The driver's lawyers are still working to have the charges dismissed.
Commercial vehicle accidents have the potential of causing catastrophic and sometimes fatal injuries, in part due to the sheer weight and size of the vehicles. If it can be determined that the accident was caused by the negligence of the truck driver, such as driving while drowsy or distracted, a personal injury attorney may suggest to a victim that the best way to seek compensation for medical expenses and other damages would be to file a civil lawsuit against the at-fault driver and, where appropriate, the driver's employer.
